These Terms of Use ("Terms") govern your access to and use of the Fippence mobile application and website (collectively, the "Service") operated by Plush Software ("Fippence", "we", "our", "us"), a Jamaican software company based in Kingston, Jamaica.
By creating an account, joining the waitlist, or using any part of the Service, you confirm that you are at least 13 years of age and that you accept these Terms.
Fippence is a grocery budgeting application that helps users track the estimated running cost of items in their shopping cart in real time, compare prices across supermarkets, and stay within a self-defined budget.
Important limitations: Fippence provides estimated prices based on our database, which is updated regularly but may not reflect real-time prices at every store. Prices in the app are for informational and budgeting purposes only. The final price you pay at the cashier is determined by the retailer — Fippence does not guarantee that app prices match checkout prices exactly.

Fippence collects and maintains a database of grocery prices from Jamaican supermarkets. This data:
You agree that Fippence is not liable for any difference between the estimated prices shown in the app and the actual prices charged at checkout.
All content, features, and functionality of the Fippence Service — including but not limited to the software, design, text, graphics, logos, and the compiled price database — are owned by Plush Software and protected by applicable intellectual property laws in Jamaica and internationally.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use. Nothing in these Terms transfers any intellectual property rights to you.
If you submit feedback, suggestions, price corrections, or other content to Fippence, you grant us a non-exclusive, royalty-free, perpetual licence to use, modify, and incorporate that content to improve the Service. You represent that any content you submit is accurate and does not infringe any third-party rights.
Fippence may link to or integrate with third-party services. We are not responsible for the content, privacy practices, or reliability of any third-party services. Use of third-party services is subject to their own terms and policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIPPENCE AND PLUSH SOFTWARE SHALL NOT BE LIABLE FOR:
Our maximum liability to you for any claim arising from your use of the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim (which, during the free beta period, is zero).
You agree to indemnify, defend, and hold harmless Fippence and Plush Software from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, where we have reasonable grounds to believe you have violated these Terms or applicable law.
You may stop using the Service at any time. If you wish to delete your account and associated data, email us at administrator@plush-soft.com.
These Terms are governed by the laws of Jamaica. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Jamaica.
We may update these Terms from time to time. We will notify you of significant changes by email or by displaying a notice within the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
